GENERAL CONDITIONS OF USE OF THE SITE AND THE SERVICES OFFERED

The use of the GGL Foundation website implies full acceptance of the general conditions of use described below. These conditions of use may be modified or supplemented at any time without notice.

 

DESCRIPTION OF SERVICES PROVIDED

The purpose of the GGL Foundation website is to provide information about all of the company’s activities. The publisher endeavors to provide information on the GGL Foundation site that is as accurate as possible. However, it cannot be held responsible for omissions, inaccuracies and shortcomings in updating, whether caused by itself or by third-party partners who provide this information.

All information on the GGL Foundation website is provided for information purposes only and is subject to change. Moreover, the information on the GGL Foundation website is not exhaustive. It is subject to changes having been made since it was put online.

 

INTELLECTUAL PROPERTY AND COUNTERFEITING

The owner of the GGL Foundation site is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the site, in particular the texts, images, graphics, logos, icons and sounds.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited, except with the prior written permission of the owner of the GGL  Foundation site.

Any unauthorized use of the site or any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the Intellectual Property Code.

LIMITATIONS OF LIABILITY

The owner cannot be held responsible for direct and indirect damage caused by access to the GGL Foundation website, and resulting from the occurrence of a bug or incompatibility.

Interactive spaces (possibility of asking questions in the contact space) are at the disposal of the users. The owner reserves the right to remove, without prior notice, any content deposited in this space that would be in violation of the legislation applicable in France, in particular the provisions relating to data protection. If necessary, the owner also reserves the possibility of calling into question the civil and/or penal responsibility of the user, in particular in the event of message with racist, injurious, defamatory, or pornographic character, whatever the support used (text, photograph…).

 

PERSONAL DATA MANAGEMENT

In France, personal data is protected by Law No. 78-87 of January 6, 1978, Law No. 2004-801 of August 6, 2004, Article L. 226-13 of the Criminal Code and the European Directive of October 24, 1995.

When using the GGL Foundation website the following information may be collected: the URL of the links through which the user accessed the GGL Foundation website, the user’s access provider, and the user’s Internet protocol (IP) address.

In any case, the owner collects personal information about the user only for the need of certain services offered by the GGL Foundation website. The user provides this information with full knowledge of the facts, particularly when they enter it. Users of the GGL  Foundation website are then informed whether or not they are required to provide this information.

In accordance with the provisions of Articles 38 and following of Law 78-17 of January 6, 1978 relating to data processing, files and freedoms, any user has a right to access, rectify and oppose personal data concerning them, by making a written and signed request, accompanied by a copy of the identity document with the signature of the holder of the document, specifying the address to which the response should be sent.

No personal information of the user of the GGL Foundation site is published without the user’s knowledge, exchanged, transferred, assigned or sold on any medium to third parties. Only the assumption of the repurchase of the GGL Foundation and its rights would allow the transmission of the said information to the eventual purchaser who would in turn be bound by the same obligation of conservation and modification of the data with respect to the user of the GGL Foundation site.

The site is not declared to the CNIL because it does not collect personal information.

The databases are protected by the provisions of the law of July 1, 1998 transposing the directive 96/9 of March 11, 1996 on the legal protection of databases.

 

HYPERLINKS AND COOKIES

The GGL Foundation site contains a number of hyperlinks to other sites, set up with the owner’s permission. However, the latter does not have the possibility of verifying the content of the sites thus visited, and consequently will not assume any responsibility for this fact.

Browsing the GGL Foundation website may result in the installation of cookies on the user’s computer. A cookie is a small file that does not allow the user to be identified, but which records information relating to the navigation of a computer on a site. The data thus obtained is intended to facilitate subsequent navigation on the site, and is also intended to allow various measures of frequentation.

Refusing to install a cookie may make it impossible to access certain services. The user can however configure his computer to refuse the installation of cookies.

APPLICABLE LAW AND JURISDICTION

Any dispute arising from the use of the GGL Foundation website is subject to French law. The competent courts of Montpellier have exclusive jurisdiction.
